Terms and Conditions – Gone TowingEffective Date: 01/06/2025

1. Acceptance of TermsBy engaging Gone Towing (“we”, “us”, “our”) for any towing, transport, recovery, or related services, you (“customer”, “you”) acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.If you do not agree to these Terms, you must not proceed with our services.
2. Services ProvidedGone Towing provides vehicle towing, accident recovery, roadside transport, machinery transport, and related services.We reserve the right to determine:the safest and most appropriate method of recovery and transport;the equipment used; andwhether subcontractors are engaged to complete services.
3. Service AuthorisationBy requesting or accepting our services, you confirm that:you are the legal owner of the vehicle or have lawful authority to authorise towing;you authorise Gone Towing to attend, recover, load, transport, and store the vehicle where required; andyou agree to complete a Tow Authority Form (written or electronic) before or during service.
4. Pricing, Estimates, and VariationsAll quotes provided are estimates only based on information supplied by the customer.Final pricing may vary where:incorrect, incomplete, or misleading information is provided;the vehicle condition differs from that described;additional recovery effort, labour, or equipment is required;access conditions are more complex than disclosed;delays, waiting time, or additional services occur.The customer acknowledges that pricing is not strictly fixed to the initial quote, and may be adjusted accordingly.Gone Towing will take reasonable steps to communicate material price changes where practicable; however, by engaging our services, the customer agrees to pay the final invoiced amount.No verbal quote is binding unless confirmed in writing.
5. Payment TermsPayment is required upon completion of service unless otherwise agreed in writing.We accept cash, EFTPOS, or other approved payment methods.Failure to pay may result in storage fees, debt recovery action, and legal enforcement.Gone Towing reserves the right to retain possession of the vehicle until full payment is received where permitted by law.
6. Cancellation and Call-Out FeesA call-out fee may apply once a driver has been dispatched.If a job is cancelled after attendance or en route, applicable fees remain payable.Additional recovery preparation costs may apply where relevant.
7. Vehicle Condition and Customer ResponsibilityThe customer is responsible for:providing accurate vehicle condition and location details;disclosing any known mechanical issues, modifications, or hazards;ensuring safe access to the vehicle.We reserve the right to refuse service if conditions are unsafe or misleading information has been provided.
8. Limitation of Liability – DamagesTo the maximum extent permitted by law, Gone Towing is not liable for:pre-existing damage to vehicles;mechanical or electrical failure unrelated to towing operations;indirect, incidental, or consequential loss (including loss of income, profit, or use);damage caused by faulty, modified, or unsafe vehicle conditions;loss or damage to personal items left inside the vehicle;damage resulting from events outside our reasonable control.Where liability cannot be excluded under the Australian Consumer Law, our liability is limited, at our option, to:resupply of the services; orthe cost of having the services resupplied.
9. Burden of Proof – Damage ClaimsWhere a customer alleges damage during service, the burden of proof rests with the customer to demonstrate that:the damage was not pre-existing; andthe damage was directly caused by negligence of Gone Towing.We may rely on pre-service photographs, tow authority forms, inspection records, and other evidence to determine vehicle condition prior to transport.
10. Damage NotificationAll damage claims must be submitted in writing within 24 hours of completion of service or delivery of the vehicle.Failure to notify within this timeframe may:limit or prevent investigation of the claim; andbe treated as acceptance that the vehicle was delivered in satisfactory condition.
11. Storage of VehiclesVehicles may be stored at our premises or an approved facility if not immediately collected.Storage fees may apply daily.Vehicles not collected within the legally required timeframe may be disposed of in accordance with Queensland legislation after proper notice.
12. Abandoned or Unclaimed VehiclesWhere a vehicle is deemed abandoned or unclaimed, Gone Towing will follow all applicable Queensland laws regarding notice, storage, and lawful disposal.
13. SubcontractorsGone Towing may engage subcontractors or third-party operators to complete services. All subcontractors are expected to meet appropriate safety and service standards.
14. Insurance and RiskWe maintain appropriate insurance for towing operations.Risk in the vehicle transfers to Gone Towing only during active towing and transport, and reverts to the customer upon delivery or completion of service.
15. Force MajeureGone Towing is not liable for any delay, failure, or inability to perform services caused by events beyond our reasonable control, including but not limited to:severe weather events (floods, storms, cyclones, fire);road closures or traffic incidents;accidents or equipment failure;government restrictions or emergencies;industrial disputes; ornatural disasters.Services may be delayed, rescheduled, or cancelled without liability in such circumstances.
16. Dispute ResolutionIf a dispute arises, the customer agrees to:Contact Gone Towing first to attempt resolution; andAllow a reasonable opportunity for investigation and response.Unresolved disputes may be handled under Queensland law.
17. PrivacyWe collect and use personal information in accordance with our Privacy Policy. Information is used for service delivery, communication, billing, and legal compliance purposes.
18. Consumer LawNothing in these Terms excludes, restricts, or modifies rights under the Australian Consumer Law. Where permitted, liability is limited as set out in these Terms.
19. Changes to TermsWe reserve the right to update these Terms at any time. The latest version will be published on our website and applies to all future services.
20. Governing LawThese Terms are governed by the laws of Queensland, Australia. Any disputes are subject to the jurisdiction of Queensland courts.
